Retainer Fee

Upon completing this contract, Client understands that there will be a $125 retainer fee for photography services. Please be sure to read the cancellation policy. Retainer and any other payments can be taken by Cash or Card. If paying by card, please let Morgan Simmons know, and she will send you the link!

Provided Documentation

All documentation created and provided to Client is owned and copywritten by Morgan Simmons and may not be sold to third parties for compensation. Morgan Simmons reserves the right to use images from your event on her social media page and in marketing materials. By signing this contract you hereby grant Simmons Photography permission to use images of everyone in the photos including minors.

Destination Weddings

For all weddings deemed as destination (Outside of the states of Indiana, Ohio, Illinois, Kentucky) additional fees are applicable, such as round trip airfare, hotel stay for 2-3 days & 1-2 nights pending complexity, and car rentals from airport and back during the stay. All travel can be arranged by clients per specifications of Simmons Photography or arranged by Simmons Photography with agreement of payment invoiced.

Subcontracted Photographers

Simmons Photography is offering a Simmons Photography Team which is in place for weddings that Morgan Simmons is already booked at. They have been selected by Simmons Photography, trained (if needed) by Morgan Simmons. Morgan Simmons will set up a consultation with client via Facetime/Zoom, Phone Call, or Lunch to go over in full detail what your dream day will look like. From there Morgan Simmons takes that info, makes a custom powerpoint in full detail of the shots client wants, that Morgan has customized and Subcontracted Photographer will follow. You absolutely may ask them to do anything you want them to do day of. ALL PHOTOS WILL BE EDITED by Morgan Simmons. Subcontracted photographers can be newer to photography, we all make mistakes with lighting and angles of shots. However, Morgan has chosen very qualified photographers that have done weddings and have photography businesses of their own and again will be trained and have Morgan on call if anything is needed. Subcontracted work is at a cheaper rate, to make budget friendly so please take that into consideration. Subcontracted Photographers are not to solicit their business. They are there on behalf of Simmons Photography Team. However, they also edit your images as they please and you are more than welcome to ask them to be tagged so you can see their work. Lastly, all payments are to be made to Morgan Simmons, subcontracted photographers are not to take or ask for any payment unless arrangements were made by Morgan Simmons and Client.

Second Photographer & Family Photographer Policy

If budget allows, Simmons Photography may hire a second photographer to assist in wedding day photography. This photographer will be of Simmons Photography’s choice; client should understand that Simmons Photography has high standards in selecting this candidate. If there is an additional photographer present at the wedding not associated with Simmons Photography, Simmons Photography reserves the right to ask them to put their devices away. Simmons Photography is a professional service and wants to ensure all of the photos captures are its own. Reminder, if second shooter is requested, it is an additional $25 an hour. Second shooters are not to solicit their own companies, please let me know if this happens.

Whats Included

Each wedding package (except for package 1) includes a complimentary engagement session (session will not be preformed until down payment is made). Package one offers a discounted rate engagement session for $80. All packages include an online gallery with all rights to images for printing, a preview of your wedding will be given within 2 days of your wedding day, a thumb drive if requested, and package 3 includes a complimentary 8x10 canvas. Simmons Photography can provide printing services such as prints, books, calendars, and canvases for additional cost.

Engagement Session

This session is up to an hour of shoot time, pets, kids and other family members are more than welcome to join. A travel fee is added if session is not in Henry County. Anything outside of Henry County is .58 cents a mile (which is the national average). Location is fully up to you! Engagement photos take up to two weeks to receive album in full. IF you do not wish to do complimentary engagement session, it does not bring down the cost of your wedding price.

Dinner The Day Of

All that I ask is if you can please budget for dinner for photographer and second shooter if your wedding is over 4 hours. I promise we will be hungry just as much as you are and its more of a hassle and time for us to bring our own dinner and try to find a microwave. If this is a huge issue, please reach out to me!

Liability

It is understood that Simmons Photography is only liable for services completed and provided by Simmons Photography and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Simmons Photography be liable for consequential damages of any kind or material not produced.

Cancellation Policy

If event is canceled, no portion of the retention fee paid ($125) to Simmons Photography will be returned. If the event is postponed, services contracted can be applied to a new date if available.

Responsibility

Simmons Photography is not responsible for acts of God, natural disasters, an act of government such as a declaration of national or local emergency, or other incidents not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations under the contract, at no additional charge to the client.

Damage or Loss of Accessories

Client agrees to exercise all due care in caring for, and preserving the property of Simmons Photography. Clients shall remain responsible for all loss or damage to equipment, up to and including actual replacement value for each missing or damaged item per cost.

Attorney

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.

Appropriate Conduct / Safe Working Environment:

The Client(s) expressly agree(s) to take best efforts to provide Simmons Photography and Simmons Photography’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either Simmons Photography or a bystander to present a threat or implied threat of injury or harm to Simmons Photography staff or equipment, Simmons Photography reserves the right to cancel all services remaining under this Agreement and leave the event. At Simmons Photography’s discretion, Simmons Photography may enact a three-strike policy. After the first offense, Simmons Photography will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), Simmons Photography shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, then Simmons Photography will immediately leave the event. If Simmons Photography leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold Simmons Photography harmless as a result of incomplete event coverage, or for a lapse in the quality of the Simmons Photography work, and the Client(s) shall be responsible for payment in full.

COVID Addendum II: It is the clients responsibility to notify Simmons Photography if anyone in attendance of wedding ceremony has been tested positive for or exposed to COVID-19 two weeks prior to event so that a new assessment can be made. Failure to do may result in cancelled services or legal action if Simmons Photography is knowingly exposed without warning.

Payment Schedule and Method

For your convenience, payments can be made online via simmonsphotographyllc.com (I will send you a link) using a valid credit card. Otherwise, payment is to be made by cash. A $125 initial retainer fee is due upon booking (See COVID Addendum I). The full payment amount is due no later than the day of your wedding. A 20% late is applied every week late after your wedding.

Please allow 4-6 weeks for photo gallery to be returned.

Refund Policy

There is no refund for any given event or reason. Client should have familiarized with Simmons Photography editing and work and has agreed to their artistic side of editing and work. If client has not by this point, please refer to Simmons Photography Facebook page or simmonsphotographyllc.com for portfolio
